Fire Fee Schedule

ORDINANCE NO. 2009-382

AN ORDINANCE AMENDING A SCHEDULE OF FEES FOR SERVICES PROVIDED BY THE CITY OF KEENE, TEXAS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KEENE, TEXAS, THAT:

SECTION ONE

There shall hereafter be a charge for fees and services as set out below:

1. Fire Alarm Systems
A 1 to 10 Devices $50
B 11 to 25 Devices $75
C 26 to 50 Devices $100
D 51 to 100 Devices $150
E 101 to 200 Devices $200
F Over 200 Devices $200 plus $50 for each additional 100 Devices; or fraction thereof in excess of 25.
G Plan Review Fee for all fire systems 25% of permit fee
2. Automatic Sprinkler System Fees
AUnderground Installation$100
B1 to 20 Sprinklers$75
C21 to 100 Sprinklers$150
D101 to 150 Sprinklers$175
E151 to 200 Sprinklers$200
FOver 200 Sprinklers$200 plus $50 for each additional 100 sprinklers or fraction thereof.
GFire Pump – Additional$100
HResidential Systems$100
IPlan review fee for all automatic sprinkler systems25% of permit fee
3. Other Extinguishing System$75
4. Underground Storage Tanks, Installation/Removal, Combustible/Flammable Liquid$75 per tank
5. Pyrotechnic Display$50 per display per day
6. LPG Installation – portable containers of less than 125 gallons water capacity at properties where natural gas service is not available$75 per container
7. Above Ground Storage Tanks Installation/Removal, Combustible/Flammable Liquid$75 per tank
8. Authorized Burning Permit For Resident$35 per burn per day
9. Authorized Burning Permit For Non-Resident/Commercial$300 per burn per day
10. Carnival/Circus Permit$50
11. Foster Home Inspection$40
12. Daycare Licensing Inspections$40
13. Health Facilities Licensing Inspections$55
14. Other Permits required by Fire Code$50
15. Re-inspection Fees$45
16. Registration of firms selling and/or servicing fire alarms, hand fire extinguishers, “Vent-a-Hood” fire extinguisher systems, and fire sprinklers within the City$50 annually

SECTION TWO

All fees set out in any other ordinance or code section are hereby repealed to the extent of any conflicts.

SECTION THREE

It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable; and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional phrase, clause, sentence, paragraph or section.

SECTION FOUR

Any person, firm, corporation or any agent or employee thereof who violates any of the provisions of this ordinance or of the codes or ordinance adopted hereby, shall be guilty of a Class “C” misdemeanor, not to exceed Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense.

SECTION FIVE

This Ordinance shall be in full force and effect from and after its passage and publication as required by law, or on July 30, 2009, whichever is later, and it is so ordained.
